Food Additives: Latest Updates

ADDITIVES AUTHORISED IN FOOD

On 30 June, two Regulations amending the legislation on food additives were published in the Official Journal of the European Union. This is an amendment to Regulation (EC) No 1333/2008 in Annex II, where the EU list of authorised additives in food is present and the conditions of their use.

Regulation 2022/1037 authorises a new additive, Glycolipids (E246), by inserting it in Annex II, Part B, point 3 of Regulation 1333/2008, under the heading “Food additives other than colours and sweeteners”.

For the additive, the use categories and maximum dosages are indicated: E246 is allowed as a preservative in certain types of beverages (category 14.1.4, category 14.1.5.5 and category 14.2.1).

Regulation 231/2012 has been implemented accordingly, introducing the specifications for the new additive.

Regulation 2022/1038 amends the fields of use of polyvinylpyrrolidone (E1201), including the possibility of using it, with a quantum Satis dosage, as a stabilizer in the food category “Foods for special medical purposes” (13.2) only for products in tablet form, whether or not coated.

Both Regulations will enter into force 20 days after their publication, therefore from 20 July 2022.

REASSESSMENT OF THE USE OF CERTAIN ADDITIVES

The European Commission, in the context of the revaluation of food additives, has requested data on the actual use of some food additives: tartaric acid (E334), sodium tartrates (E335), potassium tartrates (E336), sodium and potassium tartrate (E337), calcium tartrate (E354), metatartaric acid (E353), stearil tartrate (E483).

The scientific evaluation of EFSA highlighted the following situation in the European Union:

  1. E334, E335, E336, E337 and E354 are only used in some of the categories of food among those in which they are authorized;
  2. E353 is no longer in use;
  3. E483 does not have sufficient toxicological and technical data.

If no further details and usage data are provided, these additives may see their use categories reduced (a) or may be deleted from the list of additives allowed in the European Union (b and c).
